Important Disclaimer Regarding Our Services
24 Hour Roadside Rescue is a dispatch coordination service. We do not directly own tow trucks or employ mechanics. We connect you with independent, third-party contractors. Please read Section 3 carefully regarding limitations of liability.
1. Acceptance of Terms
By accessing our website, calling our dispatch center, or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Description of Service
24 Hour Roadside Rescue operates as a logistics and dispatch platform. Our primary service consists of:
- Receiving requests for emergency roadside assistance.
- Locating available independent towing companies, mechanics, or roadside technicians in your vicinity.
- Dispatching these third-party professionals to your location.
- Facilitating communication and payment between you and the service provider.
We do not perform the actual mechanical work, towing, or physical roadside assistance.
3. Limitation of Liability
Because we act solely as a dispatcher connecting you with independent contractors:
- We are not liable for the quality of work performed by the independent technicians.
- We are not liable for any property damage, vehicle damage, personal injury, or subsequent losses arising from the actions, negligence, or omissions of the dispatched third-party contractors.
- Any claims for damages must be directed to the specific independent service provider whose insurance covers their operational liabilities.
- We do not guarantee specific arrival times, as these are estimates subject to traffic, weather, and distance.
4. User Responsibilities
As a user of our service, you agree to:
- Provide accurate and complete information regarding your location, vehicle, and mechanical issue.
- Remain in a safe location away from active traffic while waiting for assistance.
- Ensure you have the legal right or authorization to request service for the vehicle in question.
- Be present when the technician arrives, with valid identification and proof of ownership if requested.
5. Payment Terms
Prices are quoted based on the information provided during the initial dispatch call. The final cost may vary if the actual situation differs significantly from the description provided.
A valid credit card or payment method is required to secure a dispatch. We may place a temporary hold on your card for the estimated amount. Final billing occurs after the service is completed or attempted.
6. Cancellation and Refunds
Cancellations: If you cancel your request after a technician has been dispatched, you will be subject to a non-refundable “Gone On Arrival” (GOA) or cancellation fee to compensate the technician for their fuel and time.
Refunds: Refunds for service coordination fees are handled on a case-by-case basis. Disputes regarding the actual mechanical work or towing service cost must be resolved directly with the service provider, though we will assist in facilitating communication.
7. User Conduct
You agree not to use our service for any unlawful purpose. Abusive, threatening, or harassing behavior directed at our dispatchers or the independent technicians will result in immediate termination of service without a refund.
8. Dispute Resolution
Any disputes arising out of your use of our dispatch service shall be resolved through binding arbitration in the state where the service was requested, rather than in court.
